MACC unconstitutional to sue Lim Guan Eng

MM Online - ‘Unconstitutional’ for MACC to take ‘legal action’ against Guan Eng, MP claims (extracts):


KUALA LUMPUR, Sept 6 — Opposition lawmaker N. Surendran asserted today that the Malaysian Anti Corruption Commission (MACC) would be acting against the Federal Constitution if it were to proceed with its planned “legal action’ against Penang Chief Minister Lim Guan Eng.

The Padang Serai MP said that defamation actions are available to persons but not to public-funded bodies such as the MACC, adding that this is to ensure these institutions are transparent and accountable.

“Even though, in their statement the MACC says it respects the right of any quarter to criticise it, their action in this case, from a constitutional standpoint, is to effectively prohibit such criticism.

“The law on this point is quite clear. It is unconstitutional for the State or public bodies to prohibit criticism of their actions; doing so would be in breach of Article 10 of the Constitution,” he said in a statement.

Article 10 of the Constitution guarantees every citizen the right to free speech, assembly and association, subject to certain laws and restrictions that may be imposed by Parliament.

Surendran who is also PKR vice-president then urged the MACC to reverse its decision to take legal action against Lim.


Wakakaka, I told you so (and f**k LKS for slutting with MACC).

But there is no necessity for Surendran to waste his breath urging MACC to cease and desist from its unconstitutional act, for two likely reasons, namely:

WTF does he know about civil servants and their constitutional responsibilities and limitations

(a) the MACC is set on 'harassing' Lim Guan Eng either to gain some brownie points from Ah Jib Gor or has been given instructions to do so, thus it would be a bit hard (in fact almost impossible) to persuade an attack hound from its job - for MACC it's just ikut arahan (atau bodek) Datuk lebih penting and f**k the silly Constitution, or

(b) the MACC Commissioner (like most senior civil servants in Malaysia) knows f**k-all about the Constitution where many such violations of the Constitutional provisions had, have been and will be committed by them ...

... thus Surendran is just casting pearls before sw ... er ... kambing.


Malaysian Civil Service? 

But Lim Guan Eng should not miss the BIGGEST elephant in the room, namely, the party's CEC re-elections have not yet been done and which may prove fatal to the DAP in GE-14 which may be as near as October.

Much as the DG of the RoS might have exhibited a deliberate and most un-civil-service cold-shoulder to DAP, the party must perform to the dictates of "city-hall". Don't be too engrossed in face-saving arrogance.

And expect the BN-UMNO tools like MACC, RoS, EC and police, etc, to kacau the DAP until BN is back in power after GE-14.

That's a f**king reality.

  1. Gerakan and MCA are going around Penang telling people they have learnt the lessons from the misteps before 2008, and will not repeat it. Hence it is time for Penang folks to return BN to power, with checks and balance.
